On September 15, 2026, the Federal Regional Court for the 4th Region partially upheld an appeal, declaring the license invalid on the grounds that operations had not yet commenced. 

Aguia Resources has stated it intends to file a motion for clarification, arguing that operations are active and that a suspension would cause “material harm.” The company maintains that it expects no operational interruptions, citing a 25,000-tonne stockpile of pre-processed ore and the use of a separate operating license for its Caçapava processing facility. Commercially, the company is expanding its reach through long-term sales agreements and the establishment of a branch in Uruguay.
