In one decision, the court’s Lucknow Bench ruled that CCTV footage cannot be provided to applicants through Right to Information (RTI) requests, citing Section 8(1)(g) due to the potential for sensitive information. The court noted that while direct RTI access is restricted, competent courts or commissions may direct the preservation or summoning of such footage for investigations.

In separate matters, the court addressed bail and custodial deaths. It granted bail to an individual accused of sending derogatory emails regarding the Uttar Pradesh Chief Minister, noting that slow trial progress and criminal antecedents alone are insufficient grounds for continued incarceration. 

Regarding custodial accountability, the Lucknow bench denied anticipatory bail to two Railway Protection Force (RPF) personnel accused in the death of 35-year-old Sanjay Kumar Sonkar in Gonda, Uttar Pradesh. The case involves an investigation into the theft of mustard oil tins from a goods train in late September 2025; Sonkar was reportedly taken for questioning on November 4, 2025, and his body was found in a mortuary the next morning.

Justice Manish Mathur remarked that while the COVID-19 pandemic has ended, ‘the plague of custodial deaths’ does not appear to be abating. The court suggested that in such instances, the burden of proof should ordinarily rest on police personnel to rebut misconduct allegations, noting that the appellants failed to meet this requirement at the current stage.
