The Austrian Administrative Court (VwGH) has upheld the legality of the ORF household contribution, a mandatory monthly levy of 15.30 euros introduced at the start of 2024. This decision follows a previous 2025 ruling by the Constitutional Court (VfGH) which determined the fee was constitutional because ORF content remains widely accessible.

The VwGH ruling specifically addresses concerns regarding EU state aid law, concluding that the transition from a device-based GIS fee to a device-independent model does not violate these regulations. The court also upheld the legislature’s assessment of the fee during the transition period.

This legal resolution follows a significant wave of litigation, with approximately 12,400 proceedings registered since the new system’s implementation. ORF Director General Ingrid Thurnher noted that the decision provides a “secure legal foundation” for the broadcaster’s financing and independence.
