Discussions regarding the legal classification of certain medical conditions as disabilities have emerged in Brazil, specifically concerning Type 1 diabetes and Tourette syndrome.

In the Chamber of Deputies' Health Commission, experts debated the implementation of Law 15.439/26, which allows Type 1 diabetes to be classified as a disability subject to a biopsychosocial evaluation. Karla Melo Fagundes of the Brazilian Diabetes Society characterized the condition as an “invisible disability,” noting that long-term impairments interact with social and architectural barriers. Data presented highlighted significant health challenges, including inadequate access to insulin and high rates of microvascular complications among adolescents.

Complementing these legislative debates, the Ministry of Labor and Employment (MTE) issued technical guidelines (SIT 24/2026 and 25/2026) to standardize how job vacancies reserved under the Quota Law are filled. The MTE clarified that diagnoses of Type 1 diabetes or Tourette syndrome do not automatically guarantee eligibility. Instead, auditors must conduct individualized assessments to evaluate functional impacts, significant limitations in activities, and social barriers to ensure compliance with the Brazilian Inclusion Law.
