The Brazilian Universalization Fund for Telecommunications (Fust) is currently the subject of debate regarding resource allocation and regulatory scope. Civil society groups, including the Coalition Rights on the Net, have criticized directives to allocate approximately two-thirds of Fust resources to the TV 3.0 project, arguing that this could delay broadband expansion in indigenous, rural, and urban peripheral areas. Additionally, the regulator Anatel is reviewing whether Fust contributions should apply to revenues from value-added digital services, such as streaming and cloud storage, which some companies argue are distinct from core telecom services.

In response to the fund's management, telecommunications and technology entities have been advocating for the approval of PLP 230/2025 in the National Congress to extend the ‘Fust Direto’ mechanism, which allows for the direct execution of approved projects, until the end of 2031.

On August 11, 2026, the Brazilian Chamber of Deputies approved Complementary Law Project 230/25 with 333 votes in favor and 91 against. The approved measure aims to protect Fust by preventing the freezing or redirection of funds, ensuring they are used specifically for telecommunications infrastructure and digital inclusion. Key provisions include extending the ‘Fust Direto’ mechanism until 2031 and maintaining a five-year benefit that allows companies to receive up to a 50% reduction in contributions if they invest their own resources into authorized programs. The legislation also seeks to amend the Fiscal Responsibility Law to prevent limitations on financial movements related to Fust expenses. The proposal now moves to the Federal Senate for further analysis.
