The regulatory and legal landscape for health insurance in Brazil is undergoing significant shifts regarding price adjustment mechanisms. 

The National Agency of Supplementary Health (ANS) has been studying a proposal for a ‘technical review’ mechanism. This would allow insurance operators to address economic imbalances in individual and family plans by applying adjustments diluted over three to five years, capped at 20% annually, in addition to standard annual and age-based increases.

Simultaneously, the Superior Tribunal de Justiça (STJ) has addressed the issue of ‘false collective’ corporate health insurance contracts. These are plans registered as corporate but consisting of small groups or single families. The STJ ruled that these contracts must follow the adjustment indices set by the ANS for individual and family plans, rather than the higher rates charged by operators. The court noted a significant rise in this segment, with corporate contracts involving up to five people growing 81% between December 2019 and May 2026.
