Brazilian courts have issued several rulings holding energy utility companies accountable for damages resulting from service failures and safety negligence.

In Rio Grande do Sul, a court ordered CEEE-D and Equatorial Energia S.A. to pay individual moral damages to consumers who suffered prolonged power outages following a July 2023 cyclone. The judge ruled that while the storm was intense, the delay in restoring service was due to operational failures such as material shortages and insufficient teams. The companies were also ordered to pay R$ 3 million in collective moral damages.

In other jurisdictions, the Court of Justice of Acre upheld a ruling against an energy provider for failing to maintain safety standards by keeping power active in a flooded area, which resulted in a death. Additionally, the Court of Justice of Ceará upheld a conviction against Enel, ordering compensation for a resident following a house fire attributed to electrical power fluctuations in December 2023.

More recently, the Procon Paulistano, an agency linked to the São Paulo municipal government, upheld a R$ 11.4 million fine against Enel following significant electricity supply failures in the capital between September and December 2025. The most severe disruptions occurred between December 8 and 10, leaving up to 3 million consumers without power. The municipal administration cited a failure to provide continuous and secure essential services, specifically noting issues with telephone support and information quality. Enel has expressed disagreement, stating its response was proportional to extreme weather events and noting that strong winds affected approximately 4.4 million customers in December.
