Legal actions in Chile have addressed damages caused by real estate development and infrastructure issues. In Chiguayante, the Court of Appeals of Concepción ordered Inmobiliaria Montevista SpA to implement containment measures, including stabilizing hillsides and channeling rainwater, after the company’s construction on a steep slope led to mudslides and sediment flooding. 

In a separate matter in Concepción, the Supreme Court of Chile upheld a ruling requiring Inmobiliaria Janequeo S.A. and Constructora e Inmobiliaria Esperanza S.A. to pay substantial damages. The court rejected an appeal regarding a 2019 lawsuit in which property owners claimed that nearby high-rise construction caused ground settlement, structural cracks, and exposure to noise and particulate matter. The ruling mandates payment for both material and moral damages.
