China’s Ministry of Human Resources and Social Security has released a draft regulation to protect approximately 84 million workers in “new forms of employment,” including delivery riders, ride-hailing drivers, and live-streamers. The proposal seeks to transition labor protections from policy documents into formal departmental regulations.

A central focus of the draft is addressing workers being “trapped in algorithms.” The rules would require companies to explain their algorithmic mechanisms, prohibit algorithmic discrimination, and mandate human review for significant actions like account bans or task suspensions.

The regulation categorizes workers into three groups: those with formal labor relationships, those with written service agreements, and independent freelancers. To prevent the evasion of employment responsibilities, the draft prohibits multi-layered subcontracting and the practice of inducing workers to register as individual businesses. Additional protections include minimum wage standards that account for production costs, limits on work intensity, and safeguards against weather-related risks.
