Costa Rica is experiencing internal debates regarding judicial and electoral governance. The Supreme Electoral Tribunal (TSE) recently declared a proposed bill to modify the reelection system for its magistrates unconstitutional. The TSE argued that requiring a two-thirds majority from the Supreme Court of Justice for reelection would undermine judicial independence and is “contrary to international human rights obligations by precariousness the conditions to exercise the electoral function with independence.”

In a separate development within the judiciary, senior magistrate Gerardo Alfaro Vargas has announced his candidacy for the presidency of the Supreme Court of Justice. His platform emphasizes institutional transparency, efficiency, and accountability amid rising crime rates that have strained judicial infrastructure.

Adding to the tension within the judiciary, the Appointments Commission of the Legislative Assembly has recommended against the reelection of Patricia Solano Castro as a magistrate of the Third Chamber of the Supreme Court of Justice. In a 4-3 vote, commission members cited concerns regarding her management of criminal justice and the judiciary’s response to rising insecurity and extradition cases. Deputy Marta Esquivel Rodríguez, chair of the commission, argued that Solano failed to establish a criminal policy aligned with national reality.

Solano, who has served in the judiciary since 1988, requested that the decision be based on verifiable information rather than political differences. Additionally, Deputy Esquivel raised questions regarding a ₡128 million loan granted to Solano by the Judicial Servants’ Solidarity Association, questioning the legality of the 30-year term, the technical guarantees used, and severance pay contributions made in her name.
