The New Jersey Department of Environmental Protection (DEP) issued a $1.07 million fine to DataOne, the largest environmental penalty ever levied against a data center in the state. The fine follows the discovery of 62 unpermitted natural-gas generators at the company’s facility in Vineland.

State inspectors identified the Caterpillar engines during a July site visit, noting that thermal drone footage indicated 45 of the units appeared to be operating. The Vineland site is part of a $17 billion AI infrastructure project involving a partnership with Microsoft to serve Nebius Group.

DataOne has contested the findings, arguing the generators should be classified as temporary equipment. While the company works to obtain the necessary permits, regulators have granted a 45-day window for compliance. Although the generators are currently permitted to continue operating during the application process, failure to secure the required air-quality permits could lead to a forced shutdown of the units.
