The regional government of Extremadura has initiated a process to grant the ‘Cruz de los Caídos’ in Cáceres the status of ‘Bien de Interés Cultural’ (BIC). This move aims to provide formal heritage protection to the monument, which the regional government and Cáceres City Council argue should be assessed on its artistic and architectural merits rather than its original commemorative intent. They note that a 1984 intervention removed explicit Francoist inscriptions.

This decision follows an order from Spain’s Ministry of Territorial Policy and Democratic Memory to remove the cross from public spaces, as it is labeled a Francoist symbol. The proposal has caused political friction, with the People's Party and Vox supporting the preservation of the landmark, while PSOE and Unidas Podemos argue the move conflicts with Democratic Memory legislation.

In response, historical memory associations, including Armhex and Memoria de Futuro, have launched formal opposition. These groups describe the BIC designation as a “political maneuver” resulting from agreements between the PP and Vox to bypass the Democratic Memory Law and block a state resolution from April 2026 for the monument's removal. 

To contest the status, memorialist organizations have launched a signature campaign and intend to file legal and administrative objections, including requests for access to technical reports. They maintain the monument remains a symbol of the dictatorship and the repression of the Civil War. The dispute occurs as Cáceres pursues a candidacy to become a European Capital of Culture in 2031.
