Florida is engaged in multiple legal actions concerning property insurance and risk assessment methodologies.

Attorney General James Uthmeier filed a lawsuit against First Street Technology Inc., alleging that the firm’s climate-risk modeling is deceptive and based on flawed science. The state claims these “alarmist” scores, which assess exposure to floods, fires, wind, and extreme heat, contradict federal FEMA data and negatively impact the real estate market by depressing home sales and increasing insurance costs. First Street maintains that its methodologies are validated and based on the physics of environmental perils.

In a separate matter, the Florida Supreme Court issued a unanimous ruling regarding insurance policy litigation. The court determined that homeowners with policies issued before July 1, 2021, are exempt from new pre-suit notice requirements when filing lawsuits against insurers.
