A regional court in Frankfurt am Main has ruled that Google must cease publishing three-dimensional aerial images of private residential properties on Google Earth and Google Maps if the owners object. The 3rd Civil Chamber of the District Court found that detailed 3D imagery violates the plaintiff’s general right of personality, particularly when capturing rear areas of properties, such as gardens and terraces, that are not visible to passersby from the street.

The court noted that these images could allow observers to draw conclusions about residents’ lifestyles or identify security-relevant access points. In its reasoning, the court criticized Google’s data collection methods, describing the unannounced high-altitude flights as a form of secret “spying” (Ausspähung) that prevents residents from obscuring private areas.

While Google argued that the imagery serves the public interest through the democratization of knowledge, the court determined that privacy protections outweigh these interests. The decision is not yet legally binding as an appeal is possible.
