The Landessozialgericht Berlin-Brandenburg ruled that German Pension Insurance cannot reclaim funds previously paid to a Jobcenter due to changes in legal interpretation regarding retroactive disability pension benefits. The court noted that a retiree who opted for a partial pension of 99.99% of his statutory old-age pension lost a monthly supplementary pension of €843.60 for six months, as the fund's statutes required a full statutory pension to trigger such benefits.
