Initially, HoREA and the Vietnam Real Estate Research and Evaluation Institute (VARS IRE) proposed that the usage term for condominiums be determined by the technical construction lifespan of the building. This initiative aims to improve urban land use efficiency and resolve issues related to the renovation of old apartment structures, distinguishing between long-term land use rights for commercial housing and the physical lifespan of the building itself. Subsequently, HoREA submitted recommendations concerning amendments to the Investment Law. The association proposed that when a project involving a non-reimbursable transfer is handed over to a domestic investor, the project’s operational term should be recalculated from the date the new investor takes control. This proposal seeks to provide new investors with a project lifecycle that aligns with their capital investment, provided no foreign shareholders remain in the transferred portion.
