The Supreme Court of India quashed the preventive detention of Mulla Afroz under the National Security Act (NSA), 1980. Afroz had been accused of masterminding the November 2024 Sambhal violence, which followed a court-ordered survey of the Shahi Jama Masjid.

The Court ruled that an alleged confession made while in police custody is inadmissible for establishing the “subjective satisfaction” required for such detention. Describing the state’s actions as an “illegal exercise of draconian power,” the bench imposed a ₹10 lakh fine on the Uttar Pradesh government.

In a notable gesture, the bench, comprising Justices Dipankar Datta and Sheel Nagu, dedicated the judgment to the memory of Ritwik Deswal, a law clerk and research associate who passed away recently. Justice Datta described the ruling as a “final collaboration” that carries the “quiet and indelible imprint” of Deswal’s research.
