The Supreme Court of India has issued rulings to protect homebuyers from financial penalties and deceptive marketing practices in real estate disputes.

In a case involving Granite Gate Properties Private Limited and housing projects in Noida, the Court ruled that homebuyers and new developers cannot be held liable for time-extension charges imposed by the Noida Authority. The Court set aside a previous order requiring a Committee of Creditors to pay penalties caused by delays from an insolvent developer, stating that authorities should not be “driven solely by profit” and that buyers should not be penalized for the “past sins” of the original corporate debtor.

In a separate matter regarding the DLF Primus project in Gurugram, the Court addressed deviations from original project layouts. The Bench ruled that developer brochures constitute “binding promises” rather than mere marketing material, ordering that the project be brought into conformity with the representations made to consumers after finding that promised infrastructure, such as a 24-metre-wide road, had been replaced by parking or green patches.
