Legal proceedings in Italy have increasingly recognized the link between military service and asbestos-related illnesses. 

In one case, the Italian Court of Cassation intervened to re-evaluate the rights of the children of an Air Force non-commissioned officer, C. M., who was recognized as a ‘Victim of Duty’ following his death from asbestos exposure. While the Court of Naples granted compensation for bereavement, the case underscored that technical maintenance risks extend to Air Force personnel.

Separately, the Court of Rome awarded over 410,000 euros in compensation to the family of Luigi Ricci, a former Navy sergeant. Ricci, who worked as an electrical mechanic between 1960 and 1966, died from mesothelioma caused by asbestos exposure during his service. Although the family sought recognition and dignity, the National Asbestos Observatory noted that the compensation amount was halved following an appeal by the Ministry of Defense.

Further legal developments include a ruling by the Court of Catania, which found that asbestos exposure played a ‘determinative co-causal role’ in the death of a 72-year-old man from mesothelioma. The deceased had been exposed both during his military service as an Army radio operator and during 40 years of service with the Catania Fire Department. The court designated him a victim of duty and ordered the Ministry of Defense and the Ministry of the Interior to jointly pay benefits to his widow. However, both ministries have appealed the ruling, contesting the legal connection between the service-related exposure and the disease.
