The Jamaican Firearms Act has become a point of contention between government officials and legal professionals. Senator Abka Fitz-Henley defended the legislation, specifically supporting the 15-year mandatory minimum penalty, arguing that its removal would ‘diminish the law’s effectiveness.’ He also noted a 10 per cent decrease in new Gun Court filings between 2021 and 2024.

In response to the Act, defense attorneys have escalated their opposition. Legal professionals have argued that the law removes judicial discretion and prevents judges from tailoring sentences to individual circumstances. They have also raised concerns regarding the criminalization of children and music producers who possess imitation firearms. As a form of protest, members of the Advocates Association of Jamaica and the Northern Jamaica Law Society have withdrawn services from criminal courts.

Following these protests, the Jamaican Bar Association (JAMBAR) and the Advocates’ Association of Jamaica (AAJ) reached an agreement with the government to review the Act. During a meeting, the Prime Minister and his ministerial team acknowledged the need for legislative refinement.

As a result, the Law Reform Committee has been directed to prioritize the review and reform of the Act. JAMBAR and the AAJ will lead public sensitization initiatives to educate citizens on the legal implications of the proposed reforms while maintaining consultative dialogue with the government.
