While the deal received regulatory approval in other East African markets like Uganda and Tanzania, the Kenyan requirements have led to a stalemate. Diageo and Asahi have rejected the conditions, describing them as lacking legal mandate. The High Court has since frozen the completion of the sale pending legal challenges. 

The regulatory intervention aims to protect local suppliers and the sustainability of small businesses, potentially providing increased retail access for competitors such as Heineken and Keroche Breweries. Although the transaction represents a significant potential windfall for Kenya’s National Treasury through capital gains tax, it remains halted by ongoing antitrust scrutiny and legal disputes.
