Mexico is considering several legislative and fiscal measures to strengthen copyright protections and rights-holder compensation in the digital era.

The Mexican Chamber of Deputies is reviewing reforms to the Federal Copyright Law that would introduce a “secondary liability” regime for internet service providers (ISPs). This proposal would remove safe-harbor protections for ISPs that fail to prevent or remove infringing content, potentially subjecting them to significant fines. Additionally, lawmakers are considering requirements for ISPs to implement integrity policies, including internal audits and whistleblower mechanisms.

Parallel to these regulatory shifts, authorities are exploring a new tax on electronic devices, such as cell phones, tablets, and computers. Proposed by the Ministry of Culture and various rights-holder organizations, the levy would charge up to 2% on the value of devices capable of storing or reproducing copyrighted content. This measure is framed as “compensatory remuneration for private copying” and would be applied at the point of sale or importation.

Recent developments show that the Secretaría de Cultura and the National Institute of Copyright (Indautor) are actively developing this proposal, which has been informally referred to as the “moche digital.” The levy would target products including cell phones, tablets, computers, screens, and USB drives. While a similar initiative was rejected by the Chamber of Deputies in 2021, the current approach seeks to establish the mechanism through regulations rather than direct legislative changes. Although the formal obligation would fall on producers and importers, industry estimates suggest the cost could be passed on to consumers. The Sociedad de Autores y Compositores de México (SACM) is also involved in the proposal.
