New South Wales is introducing legislation to update offences and punishments for road crimes, following recommendations from a 2025 NSW Law Reform Commission report.

The proposed reforms include new offences for dangerous driving and hit-and-runs that cause actual bodily harm. Dangerous driving causing actual bodily harm could lead to up to three years in prison, increasing to five years if aggravating circumstances exist. Failing to stop and assist after a crash causing actual bodily harm may carry a penalty of up to three years.

Additionally, the legislation targets digital conduct by proposing up to two years' imprisonment for the intentional recording and distribution of images of road crash victims without a reasonable excuse, provided the perpetrator knows or should know the victim is seriously injured, dying, or deceased. Unlawful street racing will also be categorized as an aggravating factor for dangerous driving offences.
