Following a Pennsylvania Supreme Court ruling classifying ‘skill game’ machines as illegal slot machines, the legal safe harbor for these devices expired on October 14, 2026. Because the Pennsylvania Legislature and Governor Josh Shapiro did not pass regulatory or taxing legislation during the court-ordered stay, the machines are now considered unlawful in businesses not licensed by the state Gaming Control Board.

Pennsylvania State Police have issued guidance stating that these machines, commonly found in taverns, restaurants, and social clubs, are classified as slot machines under the state’s Gaming Act and Crimes Code. Law enforcement is prepared to seize and forfeit machines, equipment, and associated proceeds. State police have clarified that simply powering off or unplugging machines will not constitute legal compliance. Businesses may face criminal charges and administrative citations that could lead to the fine or suspension of liquor licenses.

The expiration of the deadline has caused immediate economic strain. An estimated 70,000 devices have been removed from venues across the state. The Independent Fiscal Office reports these machines collectively generated more than $1 billion annually, with each unit estimated to produce approximately $47,000 per year.

Small business operators reported that the loss of revenue, coupled with rising labor and goods costs, threatens their ability to remain operational, leading to staff layoffs. State Senator Gene Yaw noted that between 30,000 and 40,000 people in Pennsylvania could be directly affected by job losses or reduced hours. Non-profit organizations, including VFW posts, have also noted the loss of revenue previously used for facility maintenance and community programming.
