The Polish Sejm passed legislation to protect beneficiaries of the ‘Clean Air’ (Czyste Powietrze) program from financial repercussions caused by contractor fraud. The bill addresses issues such as forgery and misinformation that emerged after pre-financing options were introduced in July 2022.

Under the new provisions, debt repayment can be suspended during criminal proceedings involving crimes committed against a beneficiary. If a contractor is found legally responsible for a crime that prevents a beneficiary from fulfilling their subsidy agreement, the beneficiary’s liability to repay funds may be waived. The law also allows for debts to be written off, deferred, or paid in installments for individuals in difficult life situations.

Furthermore, provincial funds for environmental protection and water management will be granted the authority to pursue fund recovery directly from unreliable contractors. The bill has moved to the Senate awaiting final presidential approval.
