In July 2026, Poland began clarifying the legal framework for installing photovoltaic panels on residential balconies. Installations up to 150 kW no longer need a building permit, but owners must obtain consent from housing cooperatives and register the system with the local electricity distributor. A draft Technical Conditions ordinance also set a timetable for making solar panels mandatory on new residential buildings, starting with single-family houses at the end of 2026 and extending to larger blocks by the end of 2029.

In August 2026, the Ministry of Development and Technology moved to finalize regulations to unify design and installation standards, with a photovoltaic (PV) regulation expected to take effect on 20 September. These rules aim to address inconsistencies in installation standards that have impacted safety and emergency response, as well as structural risks where improper mounting can damage roof coatings and lead to moisture accumulation or corrosion.

The finalized PV regulations require emergency shut-off devices, isolation-monitoring equipment, short-circuit sensors, and dedicated smoke detectors near inverters. They also mandate minimum distances from windows and doors, prohibit routing cables through occupied chimneys, and require visible signage to alert fire crews. To mitigate electrical arc risks, the rules mandate mandatory weather and UV resistance for cabling, including specific standards for module placement and ventilation, as well as the use of switches and disconnectors for both DC and AC sides.

Parallel to the PV rules, a decree regarding home battery storage established four capacity classes: up to 30 kWh, 30–60 kWh, 60–120 kWh, and above 120 kWh. The proposal relaxes requirements for smaller units, allowing batteries up to 11 kWh in apartments, balconies, or technical rooms if they meet specific enclosure and distance standards. For batteries up to 30 kWh, the decree mandates autonomous smoke and carbon-monoxide detectors.
