The regulation of short-term rentals in Poland has undergone significant shifts following a period of industry lobbying. Initial reports indicated that the Polish Ministry of Sport and Tourism held meetings with major industry players, including Airbnb and Booking.com. During this period, certain provisions that would have allowed local governments to block problematic “patho-hotels” were removed from proposed legislation following input from industry representatives.

However, the Polish Council of Ministers subsequently adopted an amendment to the law on hotel services that grants municipalities, housing associations, and cooperatives the authority to ban or restrict short-term rentals. These new regulations are designed to protect the comfort and safety of permanent residents.

Under the adopted amendment, municipalities may designate specific zones where short-term rentals are prohibited or limited by time. Housing communities and cooperatives can pass resolutions to ban daily rentals within their buildings, granting operators a six-month grace period to cease operations. Residents also gain the right to request inspections; if three violations of order or safety are recorded within six months, the property may be removed from the official registry of hotel services.

Short-term rentals of up to 30 days are now legally classified as hotel services, requiring registration in a Central List of Tourist Accommodation Objects with unique identification numbers. Administrative fines for non-compliance can reach 50,000 PLN. While full implementation is slated for 2028, certain provisions regarding safety and order may take effect sooner.
