The Office of Competition and Consumer Protection (UOKiK) has taken steps to address various forms of consumer fraud in Poland.

In the banking sector, UOKiK intervened in disputes regarding unauthorized transactions, requiring major institutions including mBank, BNP Paribas, Alior Bank, and Bank Millennium to re-evaluate thousands of previously denied claims. The regulator argued that banks incorrectly conflated technical authentication with conscious authorization by the customer. Under the Payment Services Act, banks are generally required to return stolen funds by the next business day unless they can document customer fraud.

Additionally, a new legislative project (UC142) aims to expand UOKiK’s authority to combat e-commerce fraud. The proposal would allow inspectors to conduct undercover ‘mystery shopper’ purchases using fictitious identities. Retailers found to be deceptive or in violation of statutory return rights could face penalties, including the potential loss of their web domain.
