Utah-based ice cream manufacturer Rebel Creamery filed for Chapter 11 bankruptcy protection following a legal ruling regarding its product packaging. 

A federal judge ruled that Rebel Creamery intentionally infringed upon the trade dress of Van Leeuwen Ice Cream. The court found that Rebel’s packaging—noted for its minimalist design, pastel colors, and black script lettering—was substantially similar to Van Leeuwen’s distinctive look, causing consumer confusion. 

As a result of the judgment, Rebel Creamery was ordered to pay approximately $23.8 million and must redesign its packaging. The company filed an appeal against the judgment before seeking bankruptcy protection to allow for continued daily operations and a pause on debt collection efforts.
