Jean José Dunga de Oliveira, a 41-year-old dentist in Rondônia, Brazil, was sentenced to five years and five months in prison for bodily injury after deliberately withholding his HIV-positive status from an ex-girlfriend. The court in Porto Velho also ordered him to pay R$ 50,000 in compensation to the victim. In delivering the ruling, Judge Keila Roeder applied the National Council of Justice’s ‘Protocol for Judging with a Gender Perspective’ to address the victim's vulnerability and the breach of trust caused by information asymmetry.

Investigations by the Public Ministry of Rondônia (MP-RO) indicate that Oliveira has known his status since at least 2017 and failed to strictly adhere to antiretroviral treatments, preventing him from reaching an undetectable viral load. While the defense claimed he was undergoing treatment and did not believe he was infecting others, prosecutors noted a pattern of targeting emotionally vulnerable women through effective communication to induce unprotected intercourse.

Following the conviction, the MP-RO’s Victim Assistance Center (Navit) requested, and a judge granted, a new preventive detention in a closed regime due to the ‘imminent risk of further contaminations’. While the current ruling addresses one victim, authorities suspect there may be at least four confirmed victims and potentially more unidentified individuals, as the defendant reportedly traveled frequently. Oliveira is currently facing other legal proceedings regarding similar accusations.
