Legal developments in Spain have addressed various aspects of property and community rights through judicial rulings.

The Spanish Supreme Court has reaffirmed that unpaid community fees are subject to a five-year statute of limitations under Article 1966.3 of the Civil Code. Crucially, the prescription period applies to each individual installment separately, starting from the moment that specific amount became due, rather than applying to the total accumulated debt. This period can be interrupted by actions such as an extrajudicial claim via burofax.

In the context of real estate transactions, experts advise buyers to look beyond current outstanding debts. In Catalonia, community certificates must disclose not only pending debts but also approved ordinary and extraordinary expenses and reserve fund contributions, even if they are not yet due. These rulings coincide with ongoing social challenges in community living, including disputes over noise, common area usage, and the impact of tourist rentals.

Additionally, a court in Roquetas de Mar clarified the legal distinction between illegal squatters and non-paying tenants. While Supreme Court Sentence 426/2026 allows property owners to use utility disconnections as a pressure tactic against illegal squatters, Judge Claudio García Vidales warned that applying such tactics to tenants or mortgage defaulters could constitute the crime of coercion. The court emphasized that individuals entering a property by force without any right or title are legally distinct from tenants facing financial hardship or foreclosure.
