In a ruling from ITAT Mumbai concerning the 2011-12 assessment year, the tribunal determined that pension liabilities quantified via actuarial valuation are “ascertained liabilities” rather than contingent ones, allowing them as deductions. The tribunal also ruled that MAT provisions under Section 115JB do not apply to SBI and allowed valuation losses on certain securities. In a separate matter, ITAT Rajkot ruled that SBI could not be treated as an assessee in default regarding tax deductions on Leave Fare Concession (LFC) payments for the 2016-17 and 2017-18 assessment years. Although the Supreme Court later ruled that foreign-leg travel does not qualify for certain exemptions, the tribunal found that SBI was following binding interim directions from the Madras High Court at the time.
