Texas state officials have initiated a series of regulatory actions targeting the rapid expansion of data centers to assess their impact on state resources. Governor Greg Abbott ordered the Texas Commission on Environmental Quality to halt all data center permits pending audits by the Electric Reliability Council of Texas, the Public Utility Commission of Texas, and the Texas Water Development Board. These investigations focus on electricity consumption, water usage, and grid reliability, following concerns that the interconnection queue of 474 gigawatts is five times the state’s record peak load.

Following the permit moratorium, the Texas Attorney General’s office launched an investigation into hundreds of developments across 18 counties for failing to comply with water-use reporting mandates. The inquiry targets facilities that have not responded to surveys from the Texas Water Development Board. Officials noted that accurate data is essential for the Texas State Water Plan, as some hyperscale facilities consume between 1 million and 5 million gallons of water daily for cooling.

As the crackdown on non-disclosure continues, legal experts have raised concerns regarding the efficacy of current enforcement mechanisms. Under existing state law, failure to complete mandatory water-use surveys is classified as a Class C misdemeanor, which carries a maximum fine of only $500. Critics, including representatives from the nonprofit Public Citizen, argue these penalties provide “little incentive” for large companies. Because increasing these fines would require legislative action, and the Texas legislature is not scheduled to convene until January 2027, officials are currently relying on inter-agency coordination between the water board, the TCEQ, ERCOT, and the Public Utility Commission to manage oversight.
