The Radio and Television Supreme Council (RTÜK) in Turkey has taken several regulatory actions against media outlets, prompting legal and public disputes. Açık Radyo has appealed to the Constitutional Court to overturn the revocation of its terrestrial broadcast license, contending that the decision violates constitutional rights to freedom of expression. Concurrently, RTÜK leadership has proposed new legislation to expand regulatory authority to include digital platforms through AI-driven monitoring. 

Tensions escalated following an 8 million TL fine imposed on the ATV television channel regarding the program ‘Esra Erol’da,’ which RTÜK claimed could ‘negatively affect the physical, mental, or moral development of children and youth.’ In response, Turkuvaz Medya has criticized RTÜK for unfairly targeting traditional broadcasters while failing to regulate platforms like TikTok and YouTube.

RTÜK has since extended its enforcement to major digital streaming services, imposing fines and removal orders on HBO Max, Prime Video, Netflix, and Disney+. HBO Max received a 3% fine and a removal order for the documentary ‘Bang My Box: The Robin Byrd Story,’ cited for violating regulations regarding obscenity and national, moral, and family values. Prime Video was issued a 5% fine and a removal order for ‘Spartacus: House of Ashur’ due to depictions of extreme violence and obscenity. 

Further sanctions were issued against Netflix for the film ‘Heartstopper: Sonsuza Dek,’ which RTÜK determined presented LGBTQ+ lifestyles in an ‘encouraging and normalizing’ manner to a youth audience. Additionally, Disney+ was penalized for the series ‘A Teacher,’ which the regulator categorized as depicting child abuse due to a relationship between a teacher and a minor.
