Senator Tommy Tuberville has introduced the ‘Americans First Immigration Act’ (S. 5485), a legislative proposal designed to overhaul the United States permanent residency process.

The bill proposes replacing current employment-based visa categories and the Diversity Visa Lottery with a competitive, points-based system. This new system would cap annual immigrant visas at 192,000. To qualify, applicants must be between 18 and 51 years old, possess a job offer with wages significantly above the state median, and demonstrate English language proficiency. Points would be awarded based on factors such as education, salary, and military service.

The legislation also seeks to restructure family sponsorship by excluding parents of U.S. citizens from the ‘immediate relative’ category, limiting that path to spouses and minor children. Family preference visas would be capped at 87,934, while a separate quota of 3,000 visas would be established for religious workers.

Under the proposed law, existing pending employment-based petitions could be ‘rejected, denied, or invalidated.’ Additionally, applicants would be required to sign an ‘American Values Protection’ affidavit regarding constitutional adherence and criminal history. The Senate version of the bill includes stricter criminal prohibitions and increases fines for employer non-compliance.
