The Board of Immigration Appeals (BIA) has issued a ruling that fundamentally alters the legal status of travel for certain immigrants. In the decision ‘Matter of Delcarmen-Lara’, the BIA overturned a 14-year precedent established in 2012 by ‘Matter of Arrabally and Yerrabelly’. 

Under the previous precedent, travel using advance parole—a document for individuals with pending immigration cases—did not count as a legal departure for the purpose of calculating reentry penalties. This allowed recipients of the Deferred Action for Childhood Arrivals (DACA) program to travel for work, school, or humanitarian reasons and return to the U.S. without triggering standard reentry bans. This provision had enabled many recipients to marry U.S. citizens and apply for green cards without delay.

Effective August 13, 2026, the new ruling classifies such trips as departures under the Immigration and Nationality Act. Consequently, immigrants who have accrued unlawful presence may now trigger statutory inadmissibility bars upon leaving the country, including a three-year bar for more than 180 days of unlawful presence or a ten-year bar for one year or more. The BIA noted that the Act does not explicitly provide an exception for advance parole travelers regarding these penalties.
