Recent legislative and regulatory updates in Colorado and Florida are shaping the landscape for home-based food businesses.

In Colorado, Governor Jared Polis signed HB26-1033, which will take effect on January 1, 2027. The law eases restrictions for at-home chefs and bakers by increasing the annual sales cap to $150,000, subject to inflation adjustments. Participants must register with the Colorado Department of Public Health and Environment to obtain registration numbers for product labeling. The act also includes provisions for the restaurant industry, such as prohibiting delivery drivers from handling cutlery unless requested.

In Florida, the Home Sweet Home Act allows entrepreneurs to operate from unlicensed home kitchens to produce low-risk, shelf-stable foods. Under this law, operators can earn up to $250,000 annually without requiring specific training, inspections, or food permits. However, the law prohibits the sale of products requiring refrigeration, such as those with dairy frostings. To assist with these regulations, the University of Florida Institute of Food and Agricultural Sciences has launched an educational series to help entrepreneurs manage labeling and zoning compliance.
