Vietnam has introduced measures and clarifications regarding land use right certificates, commonly known as ‘red books’.

Under Decree 123/2024/ND-CP, the government established strict administrative penalties to combat the falsification, erasure, or alteration of land documents. Individuals face fines ranging from 2,000,000 to 20,000,000 VND depending on the severity of the fraud, while organizations may face fines up to 40,000,000 VND. Serious violations may lead to criminal prosecution.

The Ministry of Natural Resources and Environment has further clarified procedures under the 2024 Land Law regarding error corrections and lost documents. For discrepancies in land plot information, such as plot numbers or area inconsistencies between adjacent properties, corrections must follow Article 152 of the 2024 Land Law, with specific administrative procedures determined by provincial People’s Committees.

In instances where original certificates are lost, the Ministry reiterated that while photocopies cannot replace originals, they may be submitted to assist land registration agencies in searching cadastral records and verifying information. For inheritance matters involving missing certificates, individuals must report the loss to competent authorities and perform registration of changes due to inheritance.

Recent guidance addresses disputes involving certificate revocation. Under Article 152 of the 2024 Land Law, certificates may be corrected, revoked, or canceled if they were issued by an incorrect authority, to the wrong subject, or contain incorrect area details. In specific local disputes, such as cases involving land held and taxed since 2000 but revoked due to alleged incorrect issuance, the Ministry noted that resolutions must be based on local archives, the legal status of the land, and specific local implementations of the law.
