Greek AADE Allows Sale of Seized Properties with Partial Debt Payment

The Independent Authority for Public Revenue (AADE) issued decision A.1158/2026, signed by Director Georgios Pitsilis, to activate article 47A of the Tax Procedure Code (law 5293/2026). The measure lets owners of tax‑seized real estate sell the property even if the sale price does not fully cover the outstanding debt. To qualify, the debtor must (i) hold a tax‑clearance certificate or debt‑confirmation, (ii) set a sale price that is not lower than the commercial or objective value of the property, and (iii) have at least 25 % of the remaining seizure debt retained from the sale proceeds by the notary and paid to AADE – the retained share may be higher based on the taxpayer’s compliance record. Applications for seizure lifting are filed electronically through the myAADE portal under “My Requests”. Previously, full repayment of the debt was required before any transfer could occur. The new framework also coincides with the European Commission’s recognition of AADE’s General Chemical Facility as a Union Testing Facility for textile products, underscoring the authority’s expanding role in both fiscal and regulatory domains.
