AbbVie files EU complaint against German drug discount laws
Pharmaceutical manufacturer AbbVie has filed a complaint with the European Commission seeking a legal review of Germany’s Statutory Health Insurance Contribution Rate Stabilization Act (BStabG). The company argues that the law’s provisions regarding cross-ingredient discount contracts for patent-protected medicines may violate EU state aid rules.
The dispute centers on so-called ‘focus lists,’ which group different active ingredients with comparable therapeutic effects. Currently, these lists cover five therapeutic groups, including inhibitors for JAK, PARP, PD-1/PD-L1, and PCSK9, as well as CGRP antagonists. Under these rules, health insurance providers can enter into discount contracts for specific patent-protected substances within a group, incentivizing doctors to prescribe those specific medications.
AbbVie contends that this system subjects certain manufacturers to disproportionate tender and discount pressure, distorting competition within the internal market. The company warned that such regulations could lead to unequal access to medical innovation and restrict physician prescribing freedom by prioritizing economic and administrative criteria over medical ones. Industry representatives, including Pharma Deutschland, have also expressed concerns that similar pricing regulations could lead to supply shortages and hinder Germany’s status as a research hub.
