ABC sues FCC over alleged retaliatory campaign against free speech

ABC, owned by The Walt Disney Co., has filed a First Amendment lawsuit against the Federal Communications Commission (FCC) in Washington, D.C. The network alleges that the agency is conducting a “retaliatory campaign” on behalf of the Trump administration to suppress its free speech.

The lawsuit specifically challenges the FCC’s demand that ABC undergo early license renewals for eight of its stations. ABC argues that the timing of this demand is politically motivated, following public attacks by President Trump and FCC Chairman Brendan Carr against the network and late-night host Jimmy Kimmel.

In addition to the license challenges, the FCC is investigating Disney’s diversity, equity, and inclusion (DEI) policies. While Chairman Carr has characterized these investigations as probes into potential “illegal DEI discrimination,” ABC and critics describe them as a pretext for political retaliation. FCC Democratic Commissioner Anna Gomez has called the agency’s recent actions “unprecedented” and “unlawful.”
