ABF orders refund of 8,300 euros following online fraud

The Arbitro Bancario Finanziario (ABF) in Palermo has ruled in favor of a client represented by lawyer Vittorio Fusco, ordering a refund of over 8,300 euros following an online fraud incident.

The fraudulent activity involved four electronic payment operations, including a recharge, a bank transfer, and two online payments to foreign merchants, totaling more than 10,800 euros. The ABF determined that technical proof of authentication alone was insufficient to absolve the financial intermediary of responsibility.

The ruling highlighted several failures by the institution, including the lack of adequate explanations when a precautionary block on a payment instrument was subsequently lifted, and an inadequate alert system. The ABF noted that communications sent to the client did not clearly specify the amount, beneficiary, or type of each individual transaction. The decision emphasizes that payment security requires effective control tools and clear communications to allow customers to identify fraud promptly.
