Acciona and ACS challenge I-24 highway concession in Tennessee

A consortium comprising Acciona, ACS, and Meridiam has filed a legal challenge in Tennessee against the awarding of the I-24 highway concession to Ferrovial, Transurban, and Tikehau Star Infra. The dispute, heard in the Davidson County Chancery Court, concerns a major toll road project valued at approximately $34 billion near Nashville.

The legal battle centers on the transparency and fairness of the procurement process. A critical point of contention is whether the consortium's right to sue was waived by accepting a $20 million stipend offered by the Tennessee Department of Transportation (TDOT) to all losing bidders. While the waiver was intended to be ‘full, unconditional and irrevocable’ upon payment, the consortium has deposited the stipend into the court where the lawsuit was filed, leaving the court to determine if the legal challenge remains valid.

Separately, Acciona has reported progress on infrastructure projects in Australia, including being selected as a preferred development partner for the Gippsland Offshore Wind Transmission Project in Victoria and receiving an award for the Clean Energy Link East in Western Australia.
