Acre Court grants habeas corpus to man held for nine months over R$ 190 theft

The Criminal Chamber of the Court of Justice of Acre (TJAC) unanimously granted habeas corpus to Everton Silva Calixto, who had been held in preventive detention for over nine months without the criminal instruction process beginning.

Calixto was accused of theft involving R$ 190, committed without violence or serious threat. The court noted that the delay in the proceedings was due to administrative scheduling conflicts within the judiciary rather than any maneuvers by the defense. The ruling emphasized that preventive detention is an exceptional measure and should not serve as a pre-emptive punishment, particularly given the non-violent nature of the alleged crime and the disproportionate length of the detention.
