Acre Court orders state to provide R$ 20,000 medication
The 2nd Civil Chamber of the Court of Justice of Acre (TJAC) has ordered the State of Acre and the Municipality of Rio Branco to provide the medication Esilato de Nintedanibe (Ofev 150 mg) to a retired resident within 60 days.
The patient is diagnosed with progressive fibrosing interstitial lung disease, a chronic and incurable condition that causes irreversible loss of respiratory capacity. Although the medication was prescribed by a specialist from the Acre Hospital Foundation (Fundhacre), it is not included in the Unified Health System (SUS) list. Each box costs approximately R$ 20,000.
The court ruled that medical reports proved the medication is indispensable and that existing SUS therapies were ineffective. The decision follows a legal action supported by the Public Defender's Office of Acre, after the patient demonstrated an inability to afford the treatment.
