Acre Court restricts automatic electronic monitoring for domestic violence convicts
The Court of Justice of Acre (TJAC) has ruled that a convict sentenced for domestic violence serving an open sentence cannot be automatically subjected to electronic monitoring. The Criminal Chamber unanimously decided that the imposition of such restrictive measures must be based on concrete evidence of an actual risk to the victim rather than mere presumption.
The court also clarified that the mandatory electronic monitoring requirements established by Law No. 14,994/2024, known as the ‘Anti-Femicide Package’, cannot be applied to crimes committed before the law took effect, as doing so would constitute a prejudicial retroactive application of the law.
