Acre electoral dispute: MPE recommends right of reply for Mailza Assis

The Electoral Public Ministry (MPE) has issued an opinion recommending that Mailza Assis be granted a right of reply following an electoral propaganda dispute involving Senator Alan Rick in Acre.

The controversy stems from a video in which Alan Rick claimed that R$ 51 million had been diverted from public education. However, the MPE's legal opinion stated that this figure actually represents the total sum of contracts under Federal Police investigation, rather than a proven amount of diverted funds. The prosecutor noted that the candidate “distorted the information” by presenting an ongoing investigation as a categorical crime.

While a preliminary injunction to immediately remove the propaganda was denied by Judge Denise Bonfim of the Regional Electoral Court of Acre (TRE-AC) to allow for deeper analysis, the MPE's recommendation for a right of reply is not a final judicial decision. Senator Alan Rick has stated that the MPE's manifestation is merely advisory and that the final word rests with the TRE-AC. He maintains that he has the right to question the state administration regarding matters of public interest.
