Agrigento court suspends 5.3 million euro seizure against AICA
The Agrigento Civil Court has ordered the immediate suspension of a forced execution and third-party seizure against AICA (Azienda Idrica Comuni Agrigentini). The legal action involved a claim exceeding 5.3 million euros, which had led to the freezing of the water utility's bank accounts at institutions including Banca Monte dei Paschi di Siena and Poste Italiane.
The dispute stems from a 2009 court ruling involving the former Azienda Consortile Acquedotto Voltano (now Voltano S.p.A.). A creditor, acting as the sole heir to a defunct company, sought to hold AICA liable for the debt, arguing the company had succeeded to the previous entity's liabilities. AICA has firmly contested this, arguing it is a distinct legal entity and is not responsible for the debts of Voltano S.p.A.
The seizure had threatened to impact the continuity of integrated water services for 33 municipalities, including Agrigento, Favara, and Porto Empedocle. While the freeze caused significant operational risks, AICA reported that there were no generalized interruptions in water supply during the incident.
