Aguia Resources faces judicial challenge over Brazilian phosphate license
Aguia Resources Limited is managing a judicial challenge regarding the environmental license for its Três Estradas Phosphate Project (TEPP) in Rio Grande do Sul, Brazil. On September 15, 2026, the Federal Regional Court for the 4th Region partially upheld an appeal, declaring the license invalid based on the assumption that operations had not commenced. Aguia’s legal team intends to file a motion for clarification, asserting that operations are active and that a suspension would cause material harm.
Despite the court ruling, the company expects no operational interruptions. Aguia is leveraging a substantial stockpile of 25,000 tonnes of pre-processed phosphate ore, which is projected to support sales for the next six months, and utilizes a separate operating license for its Caçapava processing facility. The company also receives support from the environmental regulator, FEPAM, and various industrial bodies.
On the commercial front, Aguia has secured 11,000 tonnes in long-term sales agreements and is negotiating additional orders. The company is also expanding internationally, having established a branch in Uruguay with product registration expected by mid-October 2026. Additionally, a new bagging machine is scheduled for mid-October 2026 to serve smaller agricultural producers.
