Alabama Governor Kay Ivey commutes death sentence of Toforest Johnson

Alabama Governor Kay Ivey has commuted the death sentence of Toforest Johnson to life in prison without the possibility of parole. Johnson was originally convicted for the 1995 murder of Jefferson County Deputy Sheriff William Hardy, who was shot twice in the head while working off-duty security at a hotel.

Ivey cited concerns regarding the sufficiency of direct evidence in the case. “My decision is not a determination of innocence, but a recognition that the circumstances of this case justify commuting his death sentence,” Ivey stated. The decision follows scrutiny from former public officials and the current Jefferson County District Attorney, Danny Carr, who has supported Johnson’s bid for a new trial, noting that the evidence has “unraveled over 20 years.”

Johnson has consistently maintained his innocence, claiming he was on the other side of town during the crime. Defense attorneys expressed gratitude for the commutation but emphasized that the legal battle to overturn the conviction and secure a new trial will continue.
